Under California law, employers are required to pay additional compensation to eligible employees who work more than eight hours in a day and 40 hours in a week. For every hour over eight in a day and 40 hours in any given workweek, the employer must pay the eligible employee at least one and one-half times the employee's ordinary hourly rate.

Required Meal and Rest Breaks

Many employees do not realize that they are being shortchanged when it comes to meal and rest breaks. Nonexempt (usually hourly) employees are entitled to a paid 10-minute rest break for every four hours on the clock, and a half-hour meal break for every five hours worked. These breaks should be uninterrupted so that the employee may do whatever he or she wants to do during that time.
