Understanding the Age Discrimination in Employment Act of 1967

The Age Discrimination in Employment Act of 1967 protects workers aged 40 and older from discrimination in the workplace. Congress passed this law to ensure fair treatment for older employees.

How the ADEA works

The ADEA prohibits employers from discriminating against employees or job applicants based on age. This means employers cannot refuse to hire or promote someone because they are 40 or older. Employers must treat all employees fairly, regardless of their age. They must make decisions based on skills and qualifications instead of age.

To whom the ADEA applies

The ADEA applies to employers with 20 or more employees. This includes private companies, government agencies and labor organizations. It also covers employment agencies. The law protects workers who are 40 years old or older. It does not protect workers under the age of 40. However, some states have their own laws that protect younger workers from age discrimination.
